Rights & Responsibilities of Students
Rights & Responsibilities of JWCC
Reasonableness of Accommodation
Disability services are of a personal nature, with considerations made on a case-by-case basis. JWCC reserves the right to make good-cause exceptions to its published disability procedures in certain individual circumstances, when warranted.
Disability Services must give equal consideration to protecting the rights, needs, and integrity of five entities: students with disability, peer students, faculty, academic programs, and the institution as a whole.
To be eligible for disability-related services, a student must be determined to be a qualified person with a disability as defined by the Americans with Disabilities Act of 1990 (ADA) and Section 504 of the Rehabilitation Act of 1973. The Coordinator of Disability Services makes this determination.
Under the ADA and Section 504, a person has a disability if he or she has: (a) a physical or mental impairment that substantially limits one or more of the major life activities (such as walking, standing, seeing, speaking, hearing, sitting, breathing, reading, learning, thinking, performing manual tasks, taking care of oneself); (b) has a record of such an impairment; or (c) is regarded as having such an impairment.
All disability-related documents are centrally filed in the Disability Services office. Departments or individuals on staff are not to retain any copies of such documentation within departments or offices. Existing information related to a student’s disability, including medical and diagnostic reports, should be forwarded to Disability Services on the main campus.
